Terms and Conditions

§ 1 - Provider, inclusion of the GTC

(1) The seller and contracting party for the goods displayed in our online shop “www.playground-coffee.com” is Playground Coffee GmbH, Detlev-Bremer-Str 21, 20359 Hamburg, phone 040 60854639, email store@playground-coffee.com (hereinafter referred to as “Seller”).

(2) These General Terms and Conditions form an integral part of every contractual agreement between the Provider and the respective Customer. Any conflicting terms and conditions of the Customer are hereby rejected.


§ 2 - Offer of goods and conclusion of contract

(1) The seller offers the products displayed in this online store for sale. The colors of the products displayed on the website may vary slightly depending on the customer’s web browser and monitor settings; such variations are technically impossible to avoid entirely. Product selection, the conclusion of the contract, and contract fulfillment are conducted in German.

(2) The seller makes a binding offer to sell the goods displayed in the store. By submitting the order via the “Buy” button, the customer accepts the offer. The seller confirms the conclusion of the contract via email (contract confirmation).

(3) Before accepting the purchase offer, the customer is shown a summary of the data entered for their order, including the key features of the goods. At this point, the customer has the opportunity to check the data for any input errors and, if necessary, go back one or more steps in the ordering process to change the data or cancel the order entirely.

(4) After the contract is concluded, the Provider will send the Customer the text of the contract via email. At the same time, the Provider will store the contract text in its electronic data processing system. Since the Customer does not have access to this information, it is the Customer’s responsibility to retain the email containing the contract text for their own records.


§ 3 - Prices and payment

(1) All product prices are total prices, excluding shipping costs. The prices include the applicable sales tax.

(2) Information regarding shipping costs can be found in the respective product description.

(3) The customer may use the following payment methods: bank transfer, PayPal, Shopify Pay, or cash payment to the seller.

(4) For orders paid in advance, payment must be made within one week of receipt of the order confirmation. The seller will set aside the requested goods for the customer for the duration of this payment period. The seller reserves the right to cancel the contract and sell the goods to another party if payment is not received by the due date.

(5) For shipments to countries outside the European Union, customs duties and import sales tax may apply, which the customer must pay to the customs authority upon receipt of the shipment. These charges are in addition to the purchase price and shipping costs and are beyond the seller’s control.


§ 4 - Shipping and delivery time

(1) Information regarding delivery times can be found in the respective product description. Any time frame specified in days refers to the period from the customer’s payment until delivery. If the customer has chosen to pay in cash upon pickup, the goods will not be shipped. Instead, the customer may pick up the goods at the seller’s place of business after the delivery time specified has elapsed.

(2) Multiple items ordered at the same time will be shipped together; the delivery time for the entire shipment will be determined by the item with the longest delivery time. If the customer wishes to receive a specific item with a shorter delivery time first, they must order that item separately.

(3) If an order includes goods that, for reasons of legal protection of minors, may only be delivered to adults, the delivery person is instructed to verify the recipient’s age upon delivery by checking an identification document. Without this proof of age, the delivery person may not hand over the shipment.

(4) If a delivery fails because the customer provided an incorrect or incomplete delivery address, a new delivery attempt will be made only if the customer covers the direct costs of the reshipment.

(5) The preceding paragraphs do not apply to digital content provided via email or for download.


§ 5 - Digital content

(1) Digital content provided by the seller via email or for download will not be sent by mail.

(2) If the customer, as a consumer, expressly requests that the contract be performed before the expiration of the cancellation period and confirms that this will result in the forfeiture of their right of cancellation, the provider shall make the digital content available immediately upon payment. Otherwise, the provider shall not make the digital content available to the consumer until after the expiration of the cancellation period.

(3) Receiving digital content requires that the customer have an internet connection. The provider notes that the customer’s internet service provider may charge fees for data transmission over which the provider has no control.


§ 6 - Consumer right of withdrawal

(1) A customer who purchases as a consumer is entitled to a right of withdrawal in accordance with the statutory provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.

(2) The provider grants a consumer who is permanently resident outside Germany a right of withdrawal in accordance with German requirements and legal consequences even if the consumer’s national law does not provide for a right of withdrawal or subjects withdrawal to a shorter time limit or a stricter formality than under German law.


§ 7 - Warranty (liability for defects)

The Purchaser shall have warranty claims (also referred to as liability for defects) in accordance with the statutory provisions.


§ 8 - Out-of-court dispute resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


§ 9 - Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. However, German law does not apply to consumers who are permanently resident abroad if the consumer’s national law contains provisions that cannot be derogated from by contract to the detriment of the consumer.

(2) Should any provision of these General Terms and Conditions prove to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
